Now that Ohio law classifies strangulation as a felony, the consequences could be much more severe. Strangulation includes any act impeding breathing or blood circulation, and offenders can be charged with a second, third, fourth, or fifth-degree felony, depending on the circumstances of their case. So what does this mean if you have been charged with strangulation in Ohio?

What are the Penalties for Strangulation?

Second Degree Felony

  • Imprisonment: Minimum 2 to 8 years
  • Fines: Up to $15,000

Third Degree Felony

  • Imprisonment: 9 months to 3 years
  • Fines: Up to $10,000

Fourth Degree Felony

  • Imprisonment: 6 to 18 months
  • Fines: Up to $5,000

Third Degree Felony

  • Imprisonment:  6 to 12 months
  • Fines: Up to $2,500

The level of charges may be determined by the facts of your case, including severity of harm to the victim, relationship to the victim (partner/family/household member), whether the victim was pregnant, etc. Every case is different, so it’s important to partner with a team of experienced defense attorneys to determine the best defense for you.

What Are the Long-Term Effects of Strangulation Charges?

Besides fines and imprisonment, felony charges can affect your life in many other areas such as employment and housing. Additionally, strangulation is often associated with domestic violence,  which can result in protection orders, custody disputes, and more. Fighting these charges alongside experienced attorneys could help control the outcomes of your case, and we can also fight to expunge your criminal record to minimize damages to your life.
